The Importance and Legal Mandates of Fire Risk Assessments in the UK

Under the latest fire safety legislation (effective October 2023), all business premises and communal areas in residential flats require written Fire Risk Assessments, regardless of the number of employees

This update removes the previous exemption for businesses with fewer than five employees, making it mandatory for all to document comprehensive fire safety assessments. These written assessments must cover all identified risks rather than just the significant findings.

Fire Risk Assessments remain essential for all non-domestic properties, including public and commercial spaces such as schools, warehouses, factories, licensed premises, nursing homes, care homes, offices, retail outlets, and businesses providing sleeping accommodations. 

Additionally, only a competent person—someone with the necessary training, experience, and knowledge—may conduct or update these assessments, often requiring a professional fire risk assessor for compliance.

What is a Fire Risk Assessment?

Fire risk assessments are a survey carried out on the premise to identify any fire risks in the property and to provide recommendations on how to make the premise safer.

You are responsible for fire safety in a business or other non-domestic premise if you’re: an owner, the employer, the occupier, the landlord, or a person with control of the premises, for example a building manager or managing agent.

Under Regulatory Reform (Fire Safety) Order 2005, this is known as the ‘responsible person’. If there’s more than one responsible person, you are required to work together to meet your responsibilities in relation to fire safety.
